sales tax

    Does anyone collect sales tax on transfers? The gun was purchased by the buyer from someone else. You are only doing the leagle transfer.

    Will depend on where you are- In WA state the tax dept has a wacky requirement that the dealer collect sale tax on the ENTIRE cost of the purchase. Even if the gun was bought from someone else and shipped to you for transfer.

    While a transfer would not appear to be a sales tax item, no one said tax code makes sense. Would check w/ other dealers in your area, or with state tax folks.

    The buyer is responsible for sales tax. And remember that the BATF is part of the Internal Revenue Service. And that the LGS can only get his/her FFL from the BATF.

    But should you decide not to pay, it would not be the FFL holder who has to deal with it.

    Here in NY the transfer fee in itself is not taxable. As stated above there is no taxable sale taking place therefore the transfer is not taxable.

    In Pa., services are taxable. Make sure you check your laws through your state department of revenue.
