Lets say I come across a H&R M4 Survival rifle thats missing the barrel - Can I get another barrel and still apply for the SBR paperwork or have a 16 inch barrel made for it? I would like to know if it can be ever legally owned since the were originally made with a 14 inch barrel?

    Thanks!

The receiver is the firearm. It will always be a short barreled rifle.

Actually, there were two different barrels for the M4, one short, one long. Do not possess the rifle AND a short barrel unless it is registered with the BATFE. If you have the rifle with the long barrel, that is not a SBR. The short barrel CAN be fitted with a permanently attached extension, and THEN possessed with the rifle.

A rifle receiver without a barrel is simply a rifle receiver, even if it is actually registered as a short barreled rifle.
