Gun picked up in DUI situation

    ok so i sold my Govt. XSE 1911 a while back to a gent i knew on another forum, he only paid for most of the gun and before he paid me for the rest (i thought i could trust him) he was arrested on a DUI charge and the firearm was confiscated...

    Here is my screen name, can i call the authorities in that county and tell them my gun was picked up off of a gent they arrested for DUI? I was the original owner and it is registered to me.....

    Do you think i would get the gun back?

    If you don't have any paperwork proving the gun was yours, and that you sold it, and that there is still a balance owed - you're SOL. Truthfully, you're probably SOL even if you do as I doubt any LE agency will give it to you anyway. About the only recourse I see (again if you have paperwork to prove it) is to take them to small claims court...

    sucks...i seriously regret selling that gun too, best gun i ever owned. I thought if maybe i could prove the gun shop i bought it at (they are friends of mine) maybe they could testify i bought it there and the Police would be able to see it was my gun that they would give it back with out the other gent having any paper work.

    I will have to drink to her death later :'-(

    You have discovered the fallacy of the "$5 now, $5 whenever I run you down" school of payment. What you had was an unsecured debt.

    Consider it tuition paid for a valuable learning experience.

    Many years ago, I co-signed a loan for a friend, with the warning that if he did not make his payments, I intended to break his knees. 5 months later, I got a call from the lender- he was late with a payment. When he got home, I was sitting on his front step. Holding a Louisville slugger. Left with an apology, money for the payment (part in quarters and dimes, but ALL of the amount) No more problems.

    Also last time I have co-signed for anyone. My lesson was cheaper than yours.

    The only way to get your gun back is to report it stolen. Of course then the guy that bought it from you will be charged with gun theft. If he can prove he bought it from you then you'll be charged with fraud.

    i dont want to be dishonest about the situation...just was hoping i could get my gun back.... sold it to him for $950...he paid me $900 wasnt a big deal, just hate to lose the gun like this.

    $50 out of $950 is making you lose sleep? Consider yourself lucky that it wasn't a $50 down payment and you were owed $900.

    Go have a beer and plan your next purchase :cool:

    yes yes yes ....what i guess i am failing to mention is that i SERIOUSLY loved that gun...I only sold it due to bills i needed to pay....I also sold it with the understanding that if he were ever to get rid of it then i wanted to be the first with the chance to buy it back. So iREALLY am losing my gun....it was never the $50, it was the fact that ole bessy is gone :'-(

    perhaps you should have never sold the gun in the first place.....however, I fully understand the need to pay bills, and I'm not faulting you for selling the gun to make ends meet. But, the second you sold that gun you sold your ownership rights, and that can be a hard pill to swallow.

    well i say registered but what i mean is that i bought them from the dealer and filled out all the forms....im assuming they are traceable back to me no?
    yeah, just need to accept my loss :-(

    you sold the gun, got shorted $50 and want to buy it back but it is in the posesion of your local LE. The guy chared with DUI owns the gun so if you want THAT gun you have to buy it from him after he gets it back.

    Take the 900 you sold it for and find the same gun somewhere else(i doubt its that unique)

    Payment in full even between friends.
    Cost of the lesson (just for you) $50.
    Move on, who knows your buddy may come up with the $50 at some point.

    Either way not a bad price for life lesson #438, I paid a lot more for mine.

    this was the first fire arm i purchased for myself...its the first one i customized, took apart, cleaned well...yadda yadda....It may not be unique but it was special to me.

    so very true...it could be worse
