Can you be under 21 and SBR a rifle if private party?

    I have a few months before I turn 21 and have had the 300blk itch like no other. Only thing is, I want it in SBR form and want to get a jump on the paperwork if possible. From what I've researched, it is legal if you build your own or buy private party, fill out Form 4, and throw down the 200 bucks but I thought I'd double check first

    I think you need to keep reading. 21 for an NFA item. An SBR is not a rifle, it is a Short Barreled Rifle. At 18 you can buy a rifle or shotgun. An SBR is neither.

    I might be wrong, but do not think I am. You need to check before you get too far along that road.

    Even if nothing is purchased from a dealer?

    ATF Firearms Technical Branch, Martinsburg WV. See what they say. They are the ones that have to approve the transfer, no matter WHO you get it from.

    Form 4

    Shag, your going to have to purchase the SBR, Full auto, Suppessor or Destructive device or any other NFA toy before you fill out and send in the Form 4 along with the $200 tax as the serial number of the item will have to be on the form. Even if you buy from a private party that will wait for the paperwork to clear (figure 7 months) you will still have to be of legal age to own the item before mailing the paperwork plus I doubt your CEO will sign off on it while your under age.

    I sent them an email and they referred me to the NFA handbook which I took a screen shot of. If you notice on 9.4, there is no age requirement. Just legal ownership of the firearm. I'm about to give them a call to double check
