The ATF confiscated the gun that the nut-job was trying to buy. Why do people have trust issues with the police? Lesson for the day: He just threatened to shoot some people. We did not show him any guns. Come get him out of my shop.

other than the BATF being involved and taking the pistol, the nut-job was going to buy, it sounds like everyone did the right thing. another nut-job taken into custody and hopefully getting the help he needs.

While at first glance it seems silly to confiscate the gun he wanted to buy. BUT you have to understand how the Federal Courts work. The gun is evidence that he would have actually had the means to carry out the planned attack. ATF will have the Technical branch test and evaluate the gun, shoot it to isnure it actually functions, submit a report to the US Attorney and then (maybe) return it to the store.

I seriously doubt ATF wants to do all this. "Yes, counselor, the gun was a real gun and it would have shot real bullets into real people causing real injuries and probably death." "Did I have it examined by specialists?"

WTF? A Sig P229 is a real gun. I do not need some geek in a lab coat to tell me it is a real gun and will cause real injuries, you moron. Go back to law school and take the nimrod judge with you. You attorneys are the reason all this BS happens in the first place.

If they keep the gun, does the gun store receive conpensation for it?

I doubt it. Do the authorities pay compensation for anything they take into evidence?

If I am suspected for doing something against the law and they come to my house and take my computers and my car do you think they're going to pay me for those items?

Okay, the way I'm seeing this, is a guy steals your car, so you call the police.. So they take the car forever as evidence???

depends on the circumstances of the criminal act committed. usually the property is returned when the case is disposed or settled.

Texas has a statute that essentially makes a photo of the stolen property the same evidentiary value as the actual article. This applies ONLY in Theft cases and ONLY in State courts. Feds have their own set of Rules of Evidence.
