Default Potential changes to NFA trust

http://www.thetruthaboutguns.com/2013/08/foghorn/breaking-atf-to-extend-cleo-sign-off-to-every-person-listed-on-gun-trusts/?fb_source=pubv1

ATF does not propose to eliminate the CLEO certification at this time. Rather, ATF proposes extending the CLEO certificate requirement to responsible persons of a legal entity.
Can the ATF implement on their own or do they need executive and or legislative approval?

I found the link on Reddit /firearms

Isn't this part of Obummer's executive order? I would think this could be put up for a legal challange by someone. Of course if it were lost, Obummer would not bother with congrass for anything he wanted. He would become the monarch he wishes to be.
