Little Noticed Provision Kills ATF Shotgun Ban Plans

Manasquan, NJ --(Ammoland.com)- Saiga 12’s, Benelli M4’s and virtually any other tactical/military shotgun can no longer be banned from import by the ATF.

A little noticed provision tucked into a large appropriations bill obviously flew under the radar of the “Brady Bunch” and the “Illegal Mayors.”

The new law effectively kills ATF’s plan to stop tactical/military shotgun imports by way of abusing the “sporting purpose” requirement and their agency rulemaking powers.

The “Fiscal Year 2012 Agriculture, Commerce/Justice/Science (CJS) and Transportation/Housing/Urban Development (THUD) Appropriations bills”, also known as the “Mini-Bus”, was passed by Congress, and signed into law by President Obama on November 18, 2011.

The new law reads as follows:

SEC. 541. None of the funds made available by this Act may be used to pay the salaries or expenses of personnel to deny, or fail to act on, an application for the importation of any model of shotgun if–

(1) all other requirements of law with respect to the proposed importation are met; and
(2) no application for the importation of such model of shotgun, in the same configuration, had been denied by the Attorney General prior to January 1, 2011, on the basis that the shotgun was not particularly suitable for or readily adaptable to sporting purposes.

What's really bad though, is that these new laws shouldn't even exist. It seems like it's a law saying it's illegal to break the law. Like the HR822. shouldn't be needed.

Don't applaud the tactics used to push this. It could have just as easily been the opposite.

Imagine next years bill has something like this in it.

Too bad the US congress is 27 years late and trillions of dollars short.

In 1984 Ronald Reagan became the first president to ban a long gun from import under the "sporting purposes" clause of the GCA 1968. The gun was a South African semi-auto shotgun. In 1986 Reagan banned another shotgun from import. This action by Reagan set the stage for later long gun bans by Bush I and Clinton.

DAMNIT!!! Im agreeing with yunus again. The fact that riders like this good or bad is how we got into the hell hole we are in. While the result is good in this case, its far far worse in the long run because it illustrates the problem we have with congress.

While applaud any deregulation of firearms laws this isnt the way to do it. Unfortunately its how just about all the worst things in our country are done.

This is exactly why bills passed by the Congress and signed into law are so convoluted. Nobody reads the damned things and they look at the title and the first few pages and it gets a bye!! Guess this means anything could get passed through as a rider, and that is a frightening thought all by itself!

The Keltec isn't an import. It would not have been affected by the "sporting purpose" test anyway,
