Yes, even if his right to own a hand gun has been infringed.
If he is reasonably in fear of serious bodily injury or death to himself or a third party.
He could be 'persecuted' for having a weapon if the 'law' says he can't have one, but not for the use of the weapon if it was justified.
An armed society is not always a polite society, but it is a free and safe society!
