blind new jersey man gets guns back
A judge ordered the police to return his collection. He had accidently shot himself and the guns were taken. Police said he drank too much also.
Is it up to the police to take a persons guns under these conditions. I hope not. http://newyork.cbslocal.com/2012/05/12/blind-nj-man-gets-guns-back-years-after-police-confiscated-them/ |
Absent any laws addressing operating a firearm under the influence of alcohol (stupid, but not illegal) the police had no authority to do what they did for the reasons stated. Also, it reads like the cops had the opinion that he drinks too much. Do they have any evidence of it? DUIs (for a blind guy that would be some pretty incriminating evidence)? Drunk in public? They have no authority to do a blood alcohol test under the circumstances stated in the article.
Let him keep his guns. |
If I were blind or disabled, I have to admit I'd probably
drink considerably more than I do now... |
