If you have a valid C&R license can you purchase a C&R weapon in your own state and carry it out of the gunshop without having it sent through the mail'? Every write-up on C&R rules references having the weapon sent via UPS or FedEx and it would seem rather strange if that were the case for a transaction in your own state. Why wouldn't you be able to carry it out? |

Funny you should ask. I did that 3 days ago. In the case of a face-to-face sale, you take possession then. My LGS had a nice Mossberg rifle, we haggled abit, shook hands, took a copy of my FFL out of wallet, signed it, handed it and cash to delaer, he gave me receipt. Took it home, entered in my bound volume.
I have had an 03 C&R FFL since 1976. I travel a LOT. Say I am in Denver on business- gun show there that weekend. I go to show, there is a NICE Colt Woodsman that will fill that hole in my collection. Normally, being a resident of VA, I could not buy a handgun in CO. Being a C&R FFL holder, I can. And can take possession of it then and there.
From `8 USC-923 (b) and part of 9c):
(b) Any person desiring to be licensed as a collector shall file an application for such license with the Attorney General. The application shall be in such form and contain only that information necessary to determine eligibility as the Attorney General shall by regulation prescribe. The fee for such license shall be $10 per year. Any license granted under this subsection shall only apply to transactions in curios and relics.
(c) Upon the filing of a proper application and payment of the prescribed fee, the Attorney General shall issue to a qualified applicant the appropriate license which, subject to the provisions of this chapter and other applicable provisions of law, shall entitle the licensee to transport, ship, and receive firearms and ammunition covered by such license in interstate or foreign commerce during the period stated in the license.
BATF FAQ states that C&R holders are outside the Brady law when receiving C&R firearms. __________________ What we have heah is.... failure to communicate. |

I don't know if it would be necessary to show a C&R license if you are walking out with it, If you are using your C&R to save money on a background check, Then I have no idea, But Your mileage may vary.
Locally we have a background check, Its $7, If you have a concealed carry permit the payment is waved, But they still make the call.
I don't know if a C&R would work like that or not.
Hope that helps. __________________ Have fun Brian |

You don't have to send it by carrier. That is just a "perk" when buying a c&r from out of state.
However, I have no idea about your state laws! Always follow the law in your state. |

c3shooter is spot on. I did the same thing about a week ago as I always have a copy of my c&r in my wallet. Picked up a nice Yugo m57 tokarev. You gotta love the c&r license. Best regards __________________ Ignorance is the most expensive commodity that you can own |

The sad thing is, some FFL's don't recognize the C&R license, and still try to make you do the 4473 deal. If a shop refuses to recognize mine, I simply buy from someone who will. |

As well you should. The C&R is a perfectly legit license. That's like someone saying they don't accept a valid DL as a form of ID. __________________ LONG LIVE THE REPUBLIC!! Last edited by trip286; 11-26-2011 at 11:35 PM. |

No JPat, it was a general question. I don't think that I've been in Riley's in a couple of years. Always looked but never bought anything. Have most recently been dealing with Stateline in Plaistow, Gun & Sport North in Salem,
Al's in Derry or Kitterey Trading Post up in Maine. |

I live in the "Free State" of Maryland. If I buy a C&R out of state I can have it delivered to my home with no other restrictions. If I buy it in state I have to do the 7 day wait. Many of Maryland's gun-related laws do not make any sense. |
