In order for the battle to go to the higher courts of appeal and the law to be ruled unconstitutional, the plea has to be not guilty.

These cases are all going to be appealed no matter what the judge rules. One of them is very likely to make its way to the Supreme Court in the next few years. Hopefully they'll make the right decision.

That is only part of the answer, and one possible outcome. here is a link to the NYSP guide to enforcing the "SAFE" Act, which was released 5 days before the arrest. In the magazine laws section, it clearly states that if there is no other apparent breaking of the law, the police do not have the right to check the number of rounds in your magazine.

Since the driver of the car was the person accused of a crime, and the passenger was not breaking any other law, the officer had no call to count the number of rounds in the magazine. Grounds for dismissal: Unlawful search and seizure.
