Need help with Illinois laws: an interesting case.
 
Hi all,
First off I realize no one here wants to play lawyer and I understand that, I just need some help with those of you who are familiar with Illinois laws (non Chicago area). So here's the deal. I go to university in Illinois (live off campus) but am a resident of Colorado. My father is a big time hunter and I have been around / handled guns all my life. My father handed down to me a Springfield 45 ACP that I would like to keep in my nightstand. I do not want to cc, I just want something in the house. Here is the kicker. I am 20, and I understand that if I have a parent sign with me I can legally be in possession of a handgun with a FOID card. But, can I get an FOID card as a non resident? If not I was planning on getting residence there anyway so no big deal. Second, I am flying home and will not be able to take the gun with me, but understand that it can be sent from one gunsmith to another. However once again I am not 21, but I would not be purchasing a gun from the gunsmith, only picking up my gun with my FOID card. My two questions I guess are can I get a card as a non resident, and how do I get the gun back to Illinois? Thanks again for any and all help.

i do know that the illionios foid card means absolutely nothing outside of illinios. you will get a lot of wtf is that???!?!?!???

best option leave the gun with you mom till your 21. the parental permission thing just means you can use it not posess it under 21

You cannot get a foid card without being a resident. You are in a very precarious situation with possessing the handgun and being under 21. I know its really a mess. Just keep it under wraps and dont transport it in your vehicle until you eventually get the card that allows you to exercise your constitutional rights. If you have to defend your life with it the legalities are really a mute point.

You do not want a FOID card; and as a CO resident, you cannot get a FOID card. So the question is moot.

I think that my legal contention would be that I was a Colorado resident temporarily residing in Illinois. As such, you are more effected by your own state's laws than Illinois laws. I would never carry the gun outside of my living area or concealed as Illinois does NOT allow concealed carry at all. Under some of the Illinois laws there are certain exclusions for people temporarily living in Illinois or passing through the state. That is the key for your situation. Chicago cops will tag you with local law violations because they're not taught much about the rights of non-local people passing through or temporarily residing in their area. They only care about local rules. Where many of the exclusions are is in the Illinois Conservation Code. For example in Illinois you need a FOID card to buy, use or possess ammunition UNLESS you're from out of state. In that case, you can use, buy or possess ammunition if you have a valid driver's license from your home state and so on. Trouble is that many local firearms dealers will not sell any ammo without a FOID card at all just to stay safe. So even thought you meet the legal requirements at the state level some dealers are overly cautious legally for their own safety sakes.

Take it from someone who has lived in Illinois for thirty-eight years, and seen alot. If you get into any trouble in Illinois with a firearm, no matter your age, it will follow you to any state you move to and most probably will result in a denial of any CCW permit and/or firearm purchase. Don't toy with your future in a state that firearms are taboo. Wait until you're 21 and move to a shall issue state. All the little towns in Illinois I've been to, the police will freak out even if you are discovered to have a handgun in your trunk. Illinois will do anything they can to put your buttox in jail if you are caught with a handgun in your possession. Keep your weapon in your dwelling and if you have to move it to a different location, I would suggest someone with a FOID card do it for you, weapon unloaded and locked in a case, ammo seperated, etc. Just my knowledge of how Illinois is. Good luck.

very true unless you are already a criminal type or a longtime democratic campaign donater. then they just ignore it.
