First this was posted in the IL gun forum. So I am assuming that the
OP is an IL resident.
To purchase loaded ammunition in IL one has to be 18 years of age and
possess a valid FOID card. For this reason many companies choose not to
ship loaded ammunition into Illinois for this reason.
The problem lies in if I were to purchase ammunition from a company in North
Dakota on line (or over the phone) where is the purchase taking place? Is
the purchase in IL or in ND or is it in both? Many companies in an attempt to
stay clear of future litigation will comply with both state's laws and if they
cannot comply to both set of laws reasonably; they choose not to ship loaded
ammunition to Illinois or other restrictive states. Some companies will ship to
an FFL holder for a customer that will then put to onus on the FFL holder to
check for a valid FOID card from the purchaser.
So the confused answer is what are the laws in the shipping and recieving
states and what are the legal consequences. Some states clearly define
that the transaction takes place in the state of the seller/shipper others do
not. In general, Illinois does not restrict ammunition being shipped into the
state but they would require that the seller confirms that the purchaser has
a FOID card. Not easy to do over the phone or on line. Some companies
will require you fax or mail a copy of your FOID and the seller keeps it on file.
Others avoid the complications and just choose as their policy not to ship to
Now here is a nice loophole in the whole mess. Illinois does not require a
FOID card be presented when purchasing primers, powder, cases or bullets.
I regularly order the above components shipped to my house no signature
required UPS ground. As a matter of fact a $900 order for .308 bullets,
H1000, .300 Whby Mag cases and Magnum Match primers are enroute,
some of the order has showed already. Nary a FOID to be seen... LOL
BTW, this is all from the 1968 anti gun laws passed in the wake of the 60's
