OUCH! That is a custodial tax, meaning that the seller theoretically is collecting tax from the customer and turning it over to the state. Of course, if you don't know to collect tax on that kind of sale, the tax comes out of the seller's gross profit on the sale.

That is hard to beat in many cases. Honestly, the state can be harder to deal with in many cases than the IRS.

Get your equipment gone from there, ASAP; when I worked for state tax, the agency had its own repo guys. If you were listed as an officer or incorporator of the business held liable by the state, you should clear out any bank accounts the state would have a record of (including direct deposit of tax refunds or online payments to the state). Don't just make a new account at the same bank; there is a way to subpoena a list from the bank.

Now, if your Dad has just received a "lien letter", it may not be as bad as you think, but the accountant needs to get in front of a district manager to see if payments could be worked out, ASAP.

That can get you in serious trouble. I know out here in CA a business needs to track each and every tire. Recently we got a call from the state over some tires that our landlord had apparently picked up off the side of the state highway along our leased land and disposed of them, giving our business as where the tires "originated". The state wanted to do an inspection of our business (a farm) to verify that there were no more tires. We are still trying to straighten that out.

I think there is some federal tie-in on tire disposal with the EPA or something. They are nutso about a "tire disposal fee" down here.


If it gives you any idea about the repo-reality of state tax agencies, I once saw this HUGE guy come in to the office I worked in to talk to the district manager about a tax liability. The guy was a semi-retired professional wrestler Kamala, http://en.wikipedia.org/wiki/Kamala_(wrestler) . While he was inside, the revenue officers had his car towed. This guy had to bend over to fit through a regular door; I would NOT have messed with his classic car.

Nah.... bliss is sitting in hot temps holding a firearm aimed at targets..... but for now... I have my tablet, my beer and my front porch in a rain storm
