Here I am. If she doesn't want you to fight it, then please don't. The first quote here is exactly the problem. She may get the job in the end but she will be an outcast. Who wants to go to work every day, even to a job they love, and be a misfit with the co-workers?

I would be upset if I asked someone to let it go and they decided to do for me what THEY wanted to do rather than what I wanted for myself.

If she doesn't want to be the outcast, then can she deal with not working there at all? Winds has an excellent point, but injustice was still done on the part of the hiring official. The woman with no qualifications should not be working there PERIOD, and shame on your wife's former co-workers if they make her an outcast!

I had all night to drink it over...

My wife had a RIGHT to the job. The administrator violated school board policy and ignored a prerequisite imposed by the department of education. His incompetence has caused Mrs. McCool to suffer the loss of full time employment including salary, pension, and insurance benefits. Students will suffer the disadvantages of an unqualified, inexperienced, and uneducated instructor. Her coworkers may blame Mrs. McCool for any hardship the other woman endures as a result of correcting this injustice. Workplace disputes are common and fleeting. She may reject my involvement now, but will appreciate it eventually.

Justice is blind. Her defenders are not. MisterMcCool is going to war!

Does seniority come into play?

I don't know about the EEOC. I filed a complaint at the direction of my Union president because our HR personal said in front of both of us that I did not get a transfer to an elementary school because they were looking for a male candidate. I lost but was told I would win if I hired a lawyer. It wasn't worth it. I am no longer a union member but I know that in my state that all they can bargain is money and insurance and that even blows because new laws state that if the admin and union can't come to an agreement by Oct. 1st the teachers pretty much get stuck with nothing. I wish your wife luck. Teaching is definitely not a profession where fair practices are in place.

The union may have no interest in the case as neither of the candidates are current members and either could become a member if hired. Dues are dues. However, I will ask for their assistance because Mrs. McCool was a member until she was terminated last year.
Seniority only applies to current employees.

MisterMcCool, my wife and I are in the same boat. She teaches ESL, or whatever they call it this week for a $hit-bag school district. Many injustices. She has gotten laid off and rehired several times. She has been forced into a position she's not qualified or liscenced to be in. Her optional union is a laugh. Her principal is an idiot. When I get worked up about how they treat her, it doesn't help. I would also be very careful about fighting her battles, but I feel for you. I am much the same way.
BTW, my wife has a Masters, and doesn't get anywhere near 100K. Don't know where that came from......

I say fight to get those that broke the policy axed, but do not fight for your wife to get the job back. She asked you not to. Plus it sounds like she will land on her feet just fine. Businesses love highly qualified people that will work for nothing. Maybe she can latch on somewhere else doing what she wants for little pay.

I am going fight and I expect to win. She will appreciate in a few months when the scandal is forgotten and she has the job she wants. Special education students at this school have the same instructor from kindergarten through sixth grade. She has been with them for years.

There are people in this world you can **** with. My wife is not on that list.
