Axxe : Your company should make the rental contract specify that the customer is responsible for returning the equipment in the same condition it was in when rented . Any damage, no matter the cause, would then be the customer's responsibility . You could put a ceiling on the amount to be charged, though . Offer to sell them the damaged equipment if they balk at paying for the repairs .

trip286 : Turning off the guy's rap music ? Love it ! Although the textbook answer would be to speak to the man and explain that your son is hearing the inappropriate language----which might get him to stop the behavior for good---or might get you shot these days...

actually it does. but knowing they abused it and proving it are two different things. there have been times when we knew and could prove they tore it up and we sometimes have recovered those costs. but the sad fact is, there is many times we know but just can't prove those damages.

the backhoe is going to cost probably several thousands of dollars to repair. last one was over $3500 in repair costs.

Here's an idea ! You could offer damage insurance at, say, 10% of the rental fee and make it mandatory for customers with a history of damage . Your shop could self-insure and the premiums could be a profit center .
The " insurance " wouldn't cover gross negligence etc.
