Homeowners Open Fire With AK-47 On Thieves

Friday, February 27, 2009 – updated: 2:20 pm EST February 27, 2009
ATLANTA -- A well-armed couple opened fire with an assault rifle and pistol early Friday morning on some car thieves in southwest Atlanta.

The couple at a home in the 1900 block of Childress Drive told police that after somebody tried to steal their car last week, they rigged up a homemade alarm in their carport using string and cans.

Police told Channel 2 Action News reporter Ryan Young that about 2 a.m. Friday the cans started making noise, indicating intruders were in their carport. The couple swung into action.

The husband picked up a pistol and ran outside to confront the thieves. The wife grabbed an AK-47 assault rife and joined her husband outside.

They found several men driving off in their car.

Homeowner Opens Fire

They told police when the car thieves tried to shoot at them, they opened fire with his pistol and her AK-47.

The thieves took off, leaving the couple's car behind.

When police arrived they found shell casings littering the driveway and front yard, and the couple's car riddled with bullet holes.

There was no blood at the scene so police don't think any of the thieves were hit.

There's no word on if the homeowners will face any charges.

For their sake, I hope the theives did shoot at them. Otherwise, it will be hard to prove that their lives were in danger. Theft of property is not life threatening. Good for them, though.

It's true... and shooting an AK like crazy in middle of the street it's not a good idea... what about collateral damage? pedestrian around? To where went to stop the bullets that failed (remember it's an AK!)?

Yep, agree there! This is not the wild wild west of days gone bye! In most states, you do not have a legal standing to shoot at anyone unless you are drectly threatened. Bad guys driving away with your car, and not shooting or threatening you, do not qualify!

This is the sort of thing that give gun owners a bum rap! If you are going to have firearms, you should really understand the laws in your state on how you can use them.

Stole this from another forum:
Six point checklist for when you are justified in Shooting a fleeing felon. All 6 must be present, but even then there is no guarantee you wont be charged.

1. Has to involve a heinous felony against a person, ex. murder, attempted murder, arson of occupied buildings, stranger kidnapping, violent sexual assault.
2. Felon must be known to you as the attacker, beyond a reasonable doubt that person is the attacker.
3. You should be identified or readily identifiable as the good guy.
4. The fleeing felon's escape is open ended, where capture is not immediate or immanent.
5. All other means of capture are failed or are no longer possible.
6. The felon's continued freedom presents a clear and present danger to innocent human life.
There is no duty to shoot a fleeing felon. You will not get into trouble if you do not shoot.



There are good books available from Massad Ayoob too on this topic. You do not want to be ignorant on this topic. You can easily be charged and spend some serious $, and even jail time, if you do not know the laws! Be a responsible gun owner, not some yahoo!

In Texas, the Penal Code allows you to use deadly force to protect property. To stop the commission of Theft and against the actor fleeing with your property if you reasonably believe there is no other way to get your property back. Of course this case was Georgia, so that does not apply here.

Kind of stupid to shoot up your own car to get it back. Reminds me of the statement " To save the village, we had to destroy it" I would not be surprised if the insurance company refused to repair the vehicle because the owner is the one that shot it up. Their homeowners insurance carrier will drop them like a hot potato.

I think that the couple, instead of protecting their property, were protecting the principal and making a statement to the scum.
